Rules of discovery and disclosure in highway condemnation proceedings

Existing federal and state cases are discussed on the rules of discovery and disclosure in highway condemnation proceedings. The statutes and rules adopted in various jurisdictions to resolve the uncertainties attending the discovery of expert opinion are presented. Because of the primary importance of expert testimony in condemnation actions and the wide divergence of such opinions, the field of eminent domain has produced the most activity and the greatest diversity of legal opinion in the area of pretrial discovery of the opinions and conclusions of value experts.
