An examination of the theoretical and practical aspects of determining the circumstances in civil cases and reaching the truth. Relying on his own extensive experience as a lawyer, the author addresses the issue of objective (judicial) truth; the content of truth in civil proceedings and the specifics of judicial testimony; the significance of presumption of law; rules on the admissibility of evidence; and the role of the courts of cassation and supervisory authority in determining the factual circumstances in civil cases. The author is a professor of civil law at the Moscow State Juridical Academy and a member of the Scientific Consultative Council of the Supreme Arbitrage Court of the Russian Federation.
